I. GENERAL

Welcome to the Rover Apps, LLC web site located at www.roverapps.com (such website, together with any successor website thereof, and any other websites of Rover Apps or its affiliates shall be referred to as the "Site"). Your privacy is of utmost importance to us. The success of our business is based on our ability to maintain your trust and the trust of our other users. Because we collect certain types of information about the users of our Site and the programs, software and services offered thereon (the “Services”), we feel you should fully understand the conditions of our online collection, use and disclosure of your information and how you can correct or make changes to such information. For purposes of this Privacy Statement, the terms "we," "us," "our," and "Rover Apps," refer to Rover Apps, LLC. "You" refers to you, as a user of this Site and the Services. Please note that this Privacy Policy solely applies to information we collect on or through the Site and the Services and does not apply to information we may have collected through other means. By using this Site or the Services, you consent to the terms of our Privacy Policy as described herein. If you do not consent to the terms of our Privacy Policy you do not have the right to access or use this Site nor any of the Services. If you have any questions regarding this Privacy Policy or our information collection and use practices, please contact us via any of the means set forth at the bottom of this Privacy Policy.
II. COLLECTION AND USE OF PERSONAL INFORMATION
1. Collection of Personal Information
As used in this Privacy Policy, “Personal Information” means data and information that can be used to identify a specific individual. When you register to use our Site and/or the Services, you may be asked to provide certain personal information about yourself solely for the purposes described in this Section II, such as (i) your name, mailing address, e-mail address, telephone number, the company you work for, and your title, (ii) a username and password that will be associated with your user account, and (iii) for on-line purchases, your billing and shipping information, and your credit card information. From time to time, other Personal Information may be collected on the Site, but at all times we only collect Personal Information that is voluntarily provided to us by our users. However, if you opt not to provide us with certain Personal Information, you may be unable to participate in certain promotions, receive product information, obtain online services offered by Rover Apps or buy products offered directly or indirectly through the Site.
2. Methods of Collections and Use
We may collect and use your Personal Information in any one or more of the following ways:
(a) Registration for a Site Account
In order to submit orders through our online Store (the “Store”) or to access and receive certain aspects of the Services, you may need to create an account with our Site (“User Account”). During registration, you may be required to provide your name and e-mail address, and in order to access or receive certain services or make purchases, you may also be required to provide your telephone number, mailing address, company, title, and/or certain technical information regarding the computer or device used to access the Site and/or the Services. You may also be required to provide a username and password (or we may provide you with a password), which will be used to log-in to your User Account.
It is important that you protect and maintain the security of your User Account and that you immediately notify us of any unauthorized use of your User Account. If you forget your password, you may not be able to access certain features or functionality of the Site and/or the Services, including but not limited to the ability to manage your User Account. If this should happen, you may e-mail us at privacy@roverapps.com to request a new password upon our verification of other information we maintain about you. Please see Section VII below for further details regarding our security measures and procedures.
The Personal Information we collect when you register for a User Account may be used by Rover Apps as follows: (i) for our internal tracking or research purposes, (ii) with respect to order placement and shipping (including, without limitation, to provide you with automated order status updates via e-mail), (iii) for information correction purposes, (iv) for our internal records, (v) in order to contact you to respond to your questions or requests or to provide you with technical support, (vi) to provide you with information regarding changes to the Site which may affect your User Account, your use of the Site, and/or the products and services available through the Site, (vii) for billing and collection purposes as described in “Orders” below; and (viii) to inform you of any product or promotional offers either we may have.
(b) Orders
If you place any orders for products or services available through the Store, during the ordering process you will be required to provide financial information, such as your credit card number and expiration date. This information is used for billing purposes and to fulfill your order.
If we have trouble processing an order, we will use your Personal Information to get in touch with you. To properly process your credit card information, we must share your personal and financial information with the merchant bank for authorization and approval.
If your payment is made through a third party fulfillment provider such as Amazon.com or PayPal (either, a “Payment Provider”), you will be required to open an account with such Payment Provider if you do not have one already. These Payment Providers maintain separate policies regarding their handling of Personal Data, and we have no responsibility or liability for their data handling practices. We recommend that you review the privacy policies of these Payment Providers prior to submitting any Personal Information.
In the event of your failure to pay amounts due to us when owned, we may contract with outside collections agencies and other service providers.
(c) Cookies
We may use a technology referred to as “cookies” (or other similar technology now existing or hereafter developed), which are pieces of data on your computer tied to information about you. Based on your browser type and other information provided by our cookies, we use cookies to: (i) customize certain Site content; (ii) customize your Site visitation experience and access; (iii) notify you of certain promotions, products and services that we believe may be of interest to you; and (iv) for any other purposes permitted under applicable law from time to time.
If you choose to reject the cookie, you can still browse our Site and our Store, but you may be unable to buy products from us through the Store or access certain aspects of the Services available on the Site. We will not share any Personal Information provided by our cookies with any third party, though you agree and acknowledge that we may share Non-Personal Information (as defined below) with such third parties. We will, however, link data stored in cookies to the Personal Information you submitted while on our Site. This allows us to personalize user Site preferences.
3. Sharing of Personal Information with Third Parties
We will not share your Personal Information with third parties other than as provided in this Privacy Policy. We may share your Personal Information with third parties solely in one or more of the following ways:
(a) Third Party Service Providers
We may contract with third party companies to perform services on our behalf. These services may include, but are not limited to, order fulfillment, package delivery, marketing assistance, postal and e-mail delivery, hosting services, customer service, data analysis, billing and collections and credit processing. Other than where you have a direct relationship or account with such a service provider, as in the case of Payment Providers as described in “Orders” above, the third parties we contract with for the provision of these services will be permitted to obtain only such Personal Information as they require to deliver the services. Further, such third parties are required to maintain the confidentiality of the information disclosed to them consistent with this Privacy Policy, and are prohibited from using Personal Information disclosed for any purpose other than as required for their provision of the applicable services to Rover Apps.
(b) Special Events
If you elect to participate in any promotions, surveys, questionnaires or other events during your visit to our Site and/or your use of our online Services, the rules or terms and conditions for those events may indicate that your Personal Information will be shared with third parties. By choosing to participate and submitting your Personal Information with respect to such events, you consent to disclosure of your Personal Information to such third parties. Rover Apps is not responsible for and disclaims all liability for any use of the information you choose to provide to such third parties.
(c) Safety, Security and Compliance with Law
We may disclose any information, including Personal Information, we deem necessary, in our sole discretion, to comply with any applicable law, regulation, legal process or governmental request, to enforce our rights or to protect the safety and security of our Site, our online Services or other users. We may also exchange information, including Personal Information, with other companies and organizations for credit fraud protection and risk reduction.
(d) Business Transitions
Rover Apps reserves the right to transfer your Personal Information to any of its subsidiaries or companies under common ownership with Rover Apps in an internal reorganization by updating this Privacy Policy to reflect the name of the transferee company. However, in the event Rover Apps undergoes a business transition involving a third party acquirer (a “Successor Organization”), such as a merger, acquisition by another company, or sale of all or a portion of its assets, we may transfer your Personal Information to the Successor Organization. In such event, Rover Apps will attempt to notify you via e-mail and will post a notice on the Site before your Personal Information is transferred to the Successor Organization. If the Successor Organization intends to use or disclose your Personal Information collected by Rover Apps in a manner materially inconsistent with this Privacy Policy, your Personal Information will not be transferred to such Successor Organization unless you have first agreed to such alternative use and/or disclosure (e.g. by accepting the terms of the Successor Organization's privacy policy).
4. Information for Persons Outside the United States
By consenting to this Privacy Policy, you confirm that your command and knowledge of English (or such other language, if this Privacy Policy is being provided to you by Rover Apps in such other language) is sufficient to understand the terms and conditions set forth herein. For persons in European Union countries, as used herein, terms such as "Personal Information" refer to "personal data" as defined by the Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data ("Directive"). We will not collect any personal data from you unless you provide it voluntarily by providing us with your freely given specific and informed consent. You agree that by using the Site and the Services, your personal data will be transferred to Rover Apps servers located in the United States (and/or other jurisdictions, depending on your use of the Services) in connection with the purposes stated in this Privacy Policy. You understand that the laws with respect to the protection of personal data in those jurisdictions may not be as stringent as those in your home jurisdiction.
III. PUBLIC COMMUNICATIONS FEATURES
From time to time you may be able to participate in certain activities on the Site, such as uploading or downloading Rover Apps files to publicly available folders on the Site, as well as posting reviews, and user opinions, and participating in user forms, chat rooms and/or bulletin boards which give you the opportunity to communicate or share information not just with Rover Apps but with other users of the Site (altogether, “Public Communications Features”). Be aware that when you volunteer information or create a public profile in the course of your participation in our Public Communications Features, you are also agreeing to allow certain aspects of your Personal Information to be made public. This includes your username and any Personal Information or images that you add to your signature, or that you include in any upload or posting by you when using such Public Communications Features. You acknowledge and agree that Rover Apps has no obligation to review, censor, or in any manner control the content of these Public Communications Features. Consequently, Rover Apps has no liability or responsibility for information made available through these Public Communications Features and you will be liable to Rover Apps for any liability that we incur as a result of any information submitted by you in or through the Public Communications Features.
IV. COLLECTION OF NON-PERSONAL INFORMATION
We also collect aggregate, non-personally identifiable information about you and your use of the Site that is transferred to us by your browser and/or by cookies when you access our Site and/or our online Services, and you may also be asked to provide non-personally identifiable information while using certain features or functionality available on the Site, such as your zip code and information about Site usage preferences (collectively, “Non-Personal Information”). Like most standard website servers, we use log files to collect Non-Personal Information, including internet protocol (IP) addresses, browser types, internet service providers (ISPs), referring/exit pages, platform types, date/time stamps, and the number of clicks. Non-Personal Information collected from you is used for various purposes, such as to analyze trends, improve our products and services, administer the Site and our online services, track user movement in the aggregate, customize the user experience and gather broad demographic information for aggregate use.
V. CHILDREN
This site is not intended for children under the age of 13 and we do not knowingly collect any Personal Information from such children. Children under the age of 13 should not use our Site or our online services at any time, except in the presence of, and with the express consent of, his or her parents or legal guardian. In the event that we learn that we have inadvertently gathered Personal Information from children under the age of 13, we will use reasonable efforts to erase such information from our records.
VI. PRIVACY POLICIES OF LINKED SITES AND ADVERTISERS
Our Site may contain links to other sites, as well as advertisements from companies with their own sites. These other sites may not have privacy policies, and we are not responsible for the privacy practices or the content of such sites. If you have any questions about how these other sites use your information, you should contact them directly.
VII. SECURITY
Rover Apps implements reasonable security measures to protect the security of your Personal Information both online and offline.
When our registration and order forms ask you to submit credit card and billing information, that information is encrypted during transmission using secure-socket-layer (“SSL”) technology.
Our corporate values, ethical standards, policies and practices are committed to the protection of customer information. In general, our business practices limit employee access to confidential information to those employees we reasonably believe need such information do their jobs.
Notwithstanding anything contained in this Section VII, while we take reasonable precautions against possible security breaches of the Site and our customer databases and records, no website or Internet transmission is completely secure. Consequently, Rover Apps cannot and does not guarantee that unauthorized access, hacking, data loss, or other breaches will never occur. We urge you to take steps to keep your Personal Information safe (including your User Account password), log out of your User Account after use, and close your web browser.
VIII. CORRECTION/UPDATING/REVIEWING PERSONAL INFORMATION
You may contact us at privacy@roverapps.com and request to review, amend or delete your Personal Information collected by us, and/or request us to cease collecting Personal Information from you in the future. You may also review and update much of your Personal Information by accessing your User Account.
IX. OPT-OUT
If you do not want to receive special offers, marketing communications, newsletters or other promotional communications (“Marketing Communications”) from Rover Apps, you may opt-out of future Marketing Communications by following the steps described in each such Marketing Communication, and/or you may send e-mails to privacy@roverapps.com with a request to cease receipt of such Marketing Communications. Please note that once we receive your request, it make take an additional period of time for such opt-out to become effective. Also note that if you opt-out of our Marketing Communications we may still e-mail or communicate with you from time to time if we need to provide you with information or request information from you with respect to a transaction initiated by you, a product or service you have purchased or are participating in or for other legitimate non-marketing reasons.
X. NOTIFICATION OF CHANGES
We reserve the right to change our Privacy Policy at any time. In the event we decide to make material changes to our Privacy Policy, we will attempt to notify you and other users of the Site by sending a notice to the primary e-mail address provided to us and/or by placing a notice on our Site. You should periodically check the Site for such notices.
